The company has successfully defended its trademarked ForsLean ingredient, which was contested by Creative Compounds LLC’s marketing of an ingredient called “Forsthin.”
Sabinsa Corp. (East Windsor, NJ) has successfully defended its trademarked ForsLean ingredient, which was contested by Creative Compounds LLC’s (Scott City, MO) marketing of an ingredient called “Forsthin.” Both ingredients are Coleus forskohlii extracts.
A district court ruling originally ruled that the two ingredients could not be confused with each other, but in July 2010, the U.S. Court of Appeals ruled against Creative Compounds over copyright infringement.
On January 10, the U.S. Supreme Court denied Creative Compounds’ petition for judicial review, indicating that there was potential for confusion surrounding the two ingredients.
